These Terms & Conditions ("Terms") govern your use of aquareachagency.com (the "Site") and the services offered by AquaReach Agency LLC ("AquaReach," "we," "us," or "our"). By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy.

1. About Us

AquaReach Agency LLC is a digital marketing agency providing Google Ads management, search engine optimization (SEO), and lead qualification and follow-up services to home-service contractors in the United States.

2. Services and Engagements

Descriptions on the Site are for general information. The specific scope, fees, commission structure, ad-spend responsibilities, and term of any engagement are set out in a separate written agreement or proposal between you and AquaReach. If those documents conflict with these Terms, they control for that engagement.

3. No Guarantee of Results

Results, statistics, case studies, and testimonials shown on the Site reflect specific past campaigns and are not a guarantee of future results. Marketing performance depends on many factors outside our control, including market, competition, budget, pricing, and your own sales process.

4. Application and Booking Forms

Submitting a form or booking a call does not create a client relationship or obligate either party. You agree that the information you provide is accurate and that you are authorized to provide it for your business.

5. SMS / Text Messaging

• Program description: Customer care only, including replies to inquiries and appointment coordination. We do not send marketing or promotional text messages.
• How you opt in: only by voluntarily entering your mobile number in the AquaReach Agency website chat widget provided by LeadConnector (HighLevel). Messages are sent only to numbers that have opted in.
• Consent is not required to purchase any goods or services from us.
• Message frequency varies based on your interactions with us.
• Costs: message and data rates may apply, according to your mobile plan.
• Opt-out: text STOP at any time to cancel. We will send a confirmation message and no further texts unless you opt in again.

• Carriers: wireless carriers are not liable for delayed or undelivered messages.
• Privacy: your mobile information is handled under our Privacy Policy. We do not sell or share mobile numbers or SMS opt-in data with third parties for their marketing purposes.

Our website chat widget is provided by LeadConnector (HighLevel). SMS consent comes only from a user voluntarily entering their mobile number in the chat widget. By doing so, you consent to receive customer care text messages from AquaReach Agency LLC only, such as replies to your inquiries and appointment coordination. We do not send marketing or promotional text messages. Message frequency varies. Message & data rates may apply. Reply STOP to unsubscribe or HELP for help. Consent is not a condition of purchase. To the fullest extent permitted by law, AquaReach Agency LLC and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the Site. Liability under any separate service agreement is governed by that agreement.

11. Indemnification

You agree to indemnify and hold harmless AquaReach Agency LLC from claims and expenses arising from your misuse of the Site or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Kentucky, and you consent to their jurisdiction.

We may update these Terms at any time by posting the revised version with a new "Last updated" date. Continued use of the Site means you accept the changes.
